EMPLOYMENT FIX LTD – STANDARD TERMS AND CONDITIONS OF SERVICE
These terms and conditions of service apply for all work undertaken by Employment Fix Limited (“EFL”) and its employees, for the undersigned client.
1. Fees
EFL fees are based primarily on the basis of the time it takes to perform the work required. However to ensure that you receive the most cost effective value for money fee, EFL will also take into account the following factors when setting the fee:
- The skill, specialist knowledge and responsibility involved;
- The importance and complexity of the matter and the results achieved;
- The urgency and the circumstances in which the matter is handled.
The hourly rate for Sarah McBeath of Employment Fix (NZ) Limited shall be $300 (as of 1 April 2018) plus GST and disbursements.
2. Disbursements
In addition to the fee, EFL will also charge disbursements including associated costs such as photocopying, toll calls, travel costs, faxes and courier charges.
In dealing with any matter for you where EFL may need to make payments to third parties on your behalf, EFL may require an advance payment for the full amount. On completion of the work, EFL will provide you with a full statement of your account.
3. Billing
EFL’s normal practice is to bill on a monthly basis. However, in certain circumstances this may be inappropriate and a bill will be sent at the conclusion of the work.
4. Terms of Payment
EFL’s terms of payment are 7 days from the date the bill is rendered unless alternative arrangements have been made with EFL. EFL reserves the right to charge default interest rate at 12.5% on all fees not paid by the due date. Default interest is calculated on a daily basis from the due date to the actual date (before or after judgment).
EFL also reserves the right to deduct all outstanding fees or disbursements from funds held on your behalf. You will be liable for all legal and debt collection costs that EFL may incur, including solicitor/client costs in enforcing or attempting to enforce EFL’s rights under these terms and conditions.

6. Privacy of Information
Over the course of your involvement with EFL we may collect and hold personal information concerning you. Failure to provide EFL with information may preclude EFL from providing services to you or limit the quality of the services provided. Information concerning you will be used by EFL to provide services, to obtain credit or other references, to undertake credit management and to inform you of issues and developments that may be of interest to you. You authorize us to obtain from any person or release to any person any information necessary for those purposes, and you authorize any person to release information to us that we require for those purposes.
Information concerning you will be held at EFL’s main office in Mount Maunganui. Under the Privacy Act 1993 you have the right of access to, and correction of, your personal information held by us.
7. Termination of Services
EFL reserves the right to cease to provide services in certain situations, including where your account is overdue for payment.
8. Communications
EFL does not accept any liability for loss arising from non-receipt of any communication, including email communications.
9. Confidentiality
All information and advice, written or verbal, given by EFL is to be treated as confidential and is not to be disclosed to any other party without the prior written consent of EFL.
10. Liability
EFL does not accept any liability for loss, damage or expense incurred arising from any claim, actions or proceedings of whatsoever nature brought against you as a result of a breach of agreement or negligence of you in the provision of EFL’s services and advice.
